From Gavels To Gigabytes: Justice Gavai Bats For India-Kenya Judicial Synergy To Tackle Challenges Of Digital Age
Justice BR Gavai and Justice Surya Kant are in Kenya for a week-long engagement between the two Supreme Courts. The visit, which began on March 7, is slated to conclude on March 15.

With South Asian voices roaring in global corridors, Supreme Court Judge Justice BR Gavai batted for strengthened India-Kenyan judicial ties to address common challenges in justice delivery. “At a time when the voices of the Global South are gaining prominence, it is imperative for our judiciaries to work together to address common challenges and share best practices," said Justice BR Gavai while addressing the Supreme Court of Kenya.
He added that the engagement would allow the two nations to learn from each other’s experiences in ensuring access to justice, safeguarding fundamental rights, and enhancing judicial administration.

Addressing the accelerating trend of technological advancements in judiciary, Justice Gavai highlighted that the integration of technology in the judiciary is not merely about modernisation. “It is a fundamental step toward ensuring that justice is delivered swiftly, equitably, and in a manner that is accessible to all citizens," he said.
He further added that as technology continues to evolve, new legal and constitutional questions are emerging, particularly concerning online content regulation, free speech, and hate speech on digital platforms.
“Courts are increasingly being called upon to balance freedom of expression with the need to curb misinformation and online harassment. The judiciary’s role in interpreting and defining the limits of digital rights, intermediary liability, and governmental regulation of online platforms remains crucial in both India and Kenya," the Indian Supreme Court judge emphasised.

The visit marks an important foundation to initiate vital dialogue and facilitate the mutual exchange of judicial insights and practices. The two judges would not only be meeting their counterparts but also would get a tour of the Supreme Court facilities, and visits to the Kenya Judicial Academy and the Court of Appeal.
